1. Agreement to Terms
Welcome to Dare. These Terms of Service (“Terms”) govern your access to and use of the Dare app and all related services (collectively, the “Service”). By creating an account or making a purchase, you agree to be bound by these Terms.
If you do not agree to these Terms, you may not access or use the Service. We reserve the right to modify these Terms at any time; material changes will be announced in the app. Your continued use of the Service after any changes constitutes acceptance of the modified Terms.
2. Service Description
Dare is an AI image and video creation service. The Service lets you:
- Generate media — create images and videos from prompts and reference media, including product shots and animations of still images
- Edit and transform — edit videos with instructions, swap characters into scenes, transfer motion, lipsync speech, relight media, and upscale results
- Store, revisit, and build on your generations in a personal library
Generations consume credits, which are included with subscriptions or purchased as one-time packs.
3. Accounts and Eligibility
3.1 Eligibility
You must be at least 13 years old to use Dare, and at least 18 (or the age of majority where you live) to make purchases. By using the Service, you represent that you meet these requirements.
3.2 Account Security
You are responsible for the activity that occurs under your account. Notify us immediately of any unauthorized use. We are not liable for loss arising from your failure to protect your sign-in credentials.
4. Your Content
4.1 What You May Upload
You may only upload media you own or have permission to use. You must have the consent of any real person shown before using their likeness in a generation. You represent and warrant that your uploads and the generations you request comply with these Terms and applicable law.
4.2 Ownership
You keep ownership of the media you upload. You own the generations you create to the extent permitted by law, and we take no ownership of them. You grant us the limited, non-exclusive license needed to store, process, reproduce, and display your content so the Service can function — including sharing the specific media and prompt for a generation with the AI model provider that processes it.
4.3 Prohibited Content
You may not use the Service to create or process content that:
- Depicts a real person without their consent, including non-consensual intimate imagery
- Is unlawful, deceptive, defamatory, or harassing, or impersonates another person with intent to deceive
- Sexualizes or exploits minors in any form — this results in an immediate, permanent ban and may be reported to authorities
- Infringes any third party’s intellectual property or publicity rights
- Is intended to mislead as authentic media of real events or people (including political disinformation)
We may remove content and suspend or terminate accounts that violate these rules.
5. Subscriptions and Credits
5.1 Subscriptions
Subscriptions are billed through Stripe and renew automatically until cancelled from your plan’s billing settings before the end of the current period. Plan credits are granted weekly.
5.2 Credits
- Credits are consumed when a generation starts, including generations whose results you later dislike; if a generation fails, its credits are refunded automatically
- Purchased credit packs do not expire
- Plan credits refill weekly and do not roll over unless stated otherwise
- Credits have no cash value and are not transferable
5.3 Refunds
Purchases are processed by Stripe. Except where required by law, consumed credits are not refundable.
6. AI Output
AI-generated output can be inaccurate, unexpected, or resemble other content. You are responsible for reviewing generations before relying on or sharing them, and for how you use them. Output does not represent real events unless you make that true yourself — be thoughtful about how you present AI media to others.
7. Prohibited Activities
You agree not to:
- Circumvent credit accounting, rate limits, or purchase flows
- Access the Service with automated tools or attempt to access other users’ accounts or data
- Reverse engineer, copy, or resell the Service or its models
- Interfere with the proper operation of the Service
8. Intellectual Property
The Dare app, including all software, designs, text, and imagery provided by us, is owned by Dare and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission. Section 4 governs ownership of your content.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY GENERATION WILL MEET YOUR EXPECTATIONS.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RECREATE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify, defend, and hold harmless Dare and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your content, or your violation of these Terms.
12. Termination
We may suspend or terminate your account at any time for violation of these Terms. You may stop using the Service or delete your account at any time. Upon termination, your right to use the Service ceases; provisions that by their nature should survive termination remain in effect.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms otherwise remain in full force and effect.
